Legal Notification / Privacy Policy
General Information about the Service Provider
According to bill set out in Law 34/2002, of the 11th July of the Information and Electronic Commerce Services Association, (henceforth, the LSSICE), we provide the user (henceforth, the USER), through access to the Web page named, www.hostalempuries.com, (henceforth, the WEB), the following GENERAL INFORMATION ABOUT THE SERVICE PROVIDER:

Accordingly, HOSTAL EMPÚRIES, S.A. informs the USER of the following terms and Conditions :
1. General Conditions regarding the use of the Web.
The information, commercial activities and general services provided through the WEB are subject to the terms and conditions set out in this notification, the Legal Notification / Privacy Policy, (henceforth, the NOTIFICATION), and comply with the current Spanish legislation, specifically, with the aforementioned LSSICE and the Statutary Law 15/1999, of the 13th December, of the Data Protection Act (henceforth, the DPA).
Consequently, the straightforward access and use of the WEB by any person implies the application of the USER conditions and the full acceptance of all the terms and conditions set out in this NOTIFICATION from the very moment one accesses the WEB.
As a general rule, access to the WEB, likewise the use of any other services provided by the WEB are completely free of charge.
The exception being, when the cancellation of a reservation arises, the USER must pay the costs set out in the “Policy Regarding the Cancellation of a Reservation”. To view the aforementioned costs, we refer you to the “General Conditions Regarding Reservations”.
2. Privacy Policy
The USER who wishes to put his/her personal details onto whichever of the existing WEB forms must be age 18 or over.
According to the bills of the DPA, the USER is informed that details gathered through the said forms will be stored in a file properly registered in the General Register of Protected Data, of which HOSTAL EMPÚRIES is the responsible and designated party.
The requirements of the said file are to respond the reservation and information requests of the USER, manage the WEB services, such as the Hostal blog, likewise the sending of promotional information regarding “Hostal Empúries”, (Newsletter).
The fields marked with an asterisk (*) must be filled in order to formalize the corresponding communication.
Personal details provided by the USER will not be passed on to third parties and HOSTAL EMPÚRIES, S.A. commits to treat them with the utmost confidentiality and comply to established levels of security along current guidelines.
The USER can exercise his/her rights to access, alteration, cancellation or complaint, via the terms set out in the current legislation, by means of written communication to the postal or electronic address of HOSTAL EMPÚRIES, S.A.
3. Policy Regarding Commercial E-mail.
In accordance with the LSSICE, HOSTAL EMPÚRIES, S.A. does not generate spam, nor will it send commercial e-mails via the electronic superhighway which have not been previously requested or authorized by the USER. Consequently, the USER reserves the right to give his/her expressed consent that his/her details might be used in order to send future commercial information about the Hostal, and can also use his/her e-mail address to receive the Hostal “Newsletter”.
The USER may revoke his/her consent at any time by means of completing the form created under the WEB bills or otherwise, by means of writing to the postal or electronic address of HOSTAL EMPÚRIES.
The USER is therefore informed that having once been a guest at “Hostal Empúries”, in accordance with the LSSICE, his/her e-mail address may be used to send the said commercial e-mails via the electronic superhighway without his/her prior consent, of which only deal with similar services pertinent to the original transaction. However, the USER/guest can cancel the sending of the said commercial e-mails at any time, by means of writing to the postal or electronic address of HOSTAL EMPÚRIES.
4. The Hostal Blog – Conditions of Use.
HOSTAL EMPÚRIES, S.A. provides for the USER a WEB site, called blog, (henceforth, the BLOG), where articles or messages are compiled chronologically regarding various topics relating to the Hostal.
USERS of the BLOG are urged to respect other users of the service, according to principles of non-discrimination, respect for personal dignity, the protection of young people and children, and it is therefore prohibited to publicise through the BLOG any type of erotic or pornographic material whatsoever.
Any USER will only be able to store or “enter” in the BLOG, works or productions created by him/her or works or productions by third parties, only and with previous written authorization from the respective owner or owners, except in cases of exceptions established by the rights of authorship legislation.
HOSTAL EMPÚRIES, S.A. does not necessarily agree with opinions expressed by the USERS and does not accept any responsibility for the information published by them.
Therefore, in order to avoid further responsibility, HOSTAL EMPÚRIES, S.A. will remove from the BLOG any material which may be contrary to the guidelines in the NOTIFICATION.
5. Intellectual and Industrial Property.
The brands, commercial names or logos, also and including the design, all the information and elements, (graphics, video, audio etc.), that form part of the WEB are the property of HOSTAL EMPÚRIES, S.A. and are protected under intellectual and industrial property laws. Consequently, HOSTAL EMPÚRIES, S.A. forbids the modification, alteration or creation of material or information on this WEB, and its use for purposes other than personal non-commercial use.
However, the USER is authorized to make links through the WEB only and when the author´s identity is put on record, and providing that a violation of current legislation and the pages or websites through which the link is made do not subvert moral or public order or decency and are respectful of the principles of non-discrimination, and respects personal dignity, the protection of young people and children and, in general, all those principles and values set out in article 8 of the LSSICE.
HOSTAL EMPÚRIES, S.A. reserves the right to request that the USER remove any links via the WEB at any moment and under any circumstances.
6. Cookies and Links
This WEB does not use Cookies.
HOSTAL EMPÚRIES, S.A. is not the author of the other websites which may be accessed via the use of links or hyperlinks embedded in the WEB. Consequently, the USER will accept full responsibility for its respective contents and conditions of use.
